Maplin, one of the United Kingdom’s largest specialist suppliers and retailers of electronics, was established in 1972 and operates a website at www.maplin.co.uk. This major transactional website is a regular recipient of the Hitwise Top 10 Award for its online ranking and is responsible for delivering significant revenues to the company.
The registrant in the case had configured maplon.co.uk to resolve to a pay per click website advertising similar products to those offered by the complainant. As was ultimately determined by the Nominet Expert this was clearly intended to siphon valuable traffic (and the concomitant income) away from Maplin’s own award winning website.
In the formal written decision, Nominet DRS expert, Dr. Patricia Jones, stated
‘I consider that the Domain Name was registered for the purpose of unfairly benefitting from the Complainant’s business and thereby unfairly disrupting the business of the Complainant’.
Dr Jones ordered that the domain be transferred to Maplin.
